Terms of Service

These terms are an agreement between you and ILearn Games Studios LLC, doing business as PourSlate (“PourSlate”, “we”, “us”). They cover your use of the PourSlate website and service. By creating an account you agree to them, and we record which version you agreed to and when.
1. What PourSlate does
PourSlate lets a business edit its menu in one place and show it on TV screens and on a mobile menu page that customers reach by scanning a QR code. PourSlate displays menus. It doesn't take orders or payments from your customers, and it doesn't connect to point-of-sale systems.
2. Your account
- Each account belongs to one business or organization and has one login. Keep your password private; you're responsible for activity under your account.
- Give us a working email address. Each email address can be used for one account. We use it for password resets and to contact you about your account.
- PourSlate is for businesses and organizations, such as restaurants, bars, cafés, clubs, nonprofits and events. You must be able to form a binding contract.
3. Subscription and billing
- PourSlate costs $19 per month per account. There is one plan with unlimited locations, menus, TV displays and QR codes.
- You don't need a card to create an account, build menus and preview them.
- Free trial: the first time you publish a menu, your account gets a free 7-day trial, during which published menus show on your TVs and QR pages as normal. Each account gets one trial, even if its menus are later deleted. The trial doesn't need a card, and nothing is charged when it ends.
- After the trial, publishing menus to TVs and QR codes requires a subscription. Billing starts only when you choose to subscribe from the Billing page in your dashboard. You're charged then and on the same day each month until you cancel.
- Subscriptions are sold through Link, the merchant of record service of our payment provider, Stripe. Link charges your payment method, adds any sales tax, VAT or GST that applies, and sends your receipts and invoices. Link's own terms also apply to the payment. Your statement shows the charge as “LINK.COM* POURSLATE”. Checkout may show the price in your local currency. We don't receive or store your full card number.
- You can cancel from the Billing page at any time, or from your Link account at link.com. When you cancel, your subscription stays active until the end of the period you've paid for, and you won't be charged again.
- Refunds: we don't refund payments, including for partly used months, except where the law requires. If you think you were charged by mistake, contact us within 30 days and we'll look into it. You can also ask Link support about a payment; Link may refund payments within 60 days in some cases.
- Price changes: we'll email you at least 30 days before a new price takes effect. It applies from your first billing date after that, and you can cancel before then.
- If a payment fails, everything keeps working while the card is retried, and we'll ask you to update it. If the payment still can't be collected, the subscription ends.
- When your free trial or a subscription ends, your published menus stop showing on TVs and QR pages, and you can't publish until you subscribe. Your account and menus are kept, and come back as soon as you subscribe.
4. Your content
- Your menus, prices, descriptions, photos and logos stay yours. You give us permission to store, process and display them only as needed to run PourSlate for you, including on your public menu pages and TV screens.
- Published menus are public: anyone with the menu's QR code or link, or a TV display link, can view them. Drafts and previews are only visible to you when logged in.
- You're responsible for your menu being accurate and lawful, including prices, allergen and dietary information, and any required disclosures. PourSlate shows what you publish.
- Only upload content you have the right to use.
5. Acceptable use
Don't use PourSlate to publish unlawful, misleading or infringing content, to interfere with the service or other customers' accounts, or to try to access data that isn't yours. We may remove content or suspend an account that breaks these rules.
PourSlate's software, design and brand belong to us. These terms let you use PourSlate; they don't give you any other rights to it. Don't copy, resell or reverse-engineer it.
6. TV screens and QR menus
- TV screens need a supported setup, described on our support page. Other devices may not work.
- After you publish, open TV screens update on their own, and QR menus show the change when they're opened or refreshed. A TV that loses its connection keeps showing the last menu it loaded.
7. Ending your account
You can stop using PourSlate at any time. To delete your account and its data, contact us (see below); there's no self-serve delete button yet. Within 30 days of your request, we'll cancel any subscription and delete your account from PourSlate, except billing records, which we keep for up to 7 years for tax purposes. Copies in backups and logs are deleted on the schedules in our Privacy Policy. Asking Link to delete your payment information cancels your subscription but doesn't delete your PourSlate account. We may suspend or close accounts that break these terms or leave bills unpaid, with notice where practical.
8. Disclaimers and liability
PourSlate is provided “as is” and “as available.” To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that PourSlate will be uninterrupted, error-free or secure, that your TVs and QR menus will always be reachable, or that content you store will never be lost. Keep your own copy of anything important, such as your prices and photos.
You're responsible for your menu content (see section 4) and for your own internet connection, TVs, computers and other equipment. We aren't responsible for losses caused by content you publish, such as wrong prices or allergen information, or by problems with your equipment or connection.
Limitation of liability. To the fullest extent the law allows:
- we won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, sales, data or goodwill, even if we were told they were possible; and
- our total liability for all claims relating to PourSlate or these terms is limited to the greater of the amount you paid us in the 12 months before the event that gave rise to the claim, or $100.
These limits apply whatever the legal theory, whether contract, tort (including negligence) or anything else, and even if a remedy fails of its essential purpose. They don't limit any liability that the law doesn't allow to be limited.
Indemnity. You agree to cover our reasonable costs, including legal fees, and any damages we have to pay, arising from a third party's claim about content you publish through PourSlate or about your breach of these terms.
9. Changes to these terms
If we change these terms, we'll post the new version here with a new version number and effective date. For significant changes, we'll email account owners at least 14 days before they take effect. If you keep using PourSlate after that, the new terms apply; if you don't agree with them, you can cancel.
10. Governing law
These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute arising from these terms or PourSlate will be heard in the state or federal courts located in Colorado, and you and we consent to those courts' jurisdiction.
11. General
- These terms, together with our Privacy Policy, are the whole agreement between you and us about PourSlate.
- If a court finds part of these terms unenforceable, that part is limited as little as possible and the rest stays in effect.
- If we don't enforce part of these terms at some point, we can still enforce it later.
- We may transfer these terms to a company that takes over PourSlate. You can't transfer them without our written agreement.
- We aren't responsible for delays or failures caused by events outside our reasonable control, such as outages at our hosting or payment providers.
